Terms of Use

These Terms of Use ("Terms") govern your access to and use of FootAI: Football Predictions (the "App") and related websites and services (together, the "Service"). By using the Service or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.

The Service

The Service provides football-related statistical analysis, forecasts, and informational content generated using algorithmic models. The Service is provided for informational and entertainment purposes only.

No Guarantee of Results

Predictions, probabilities, and analysis provided through the Service are estimates based on historical data and statistical models. They are not statements of fact and do not guarantee any outcome. We make no representation that any prediction will be accurate. You are solely responsible for any decisions you make based on the Service, and you use the Service at your own risk.

The Service does not accept bets, place wagers, or handle gambling funds, and is not a gambling operator. If you choose to use information from the Service in connection with betting, you do so entirely at your own risk and are responsible for complying with all laws applicable to you. Betting may be restricted or prohibited in your jurisdiction. Only participate where it is legal and only with money you can afford to lose.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher, to use the Service. By using the Service you represent that you meet this requirement.

Accounts

You are responsible for maintaining the confidentiality of any credentials associated with your access to the Service and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Subscriptions, Billing, and Payments

The Service is offered on a subscription basis. By purchasing a subscription, you agree to the pricing and billing terms presented to you at the time of purchase.

Subscriptions renew automatically at the end of each billing period at the then-current rate until cancelled. You will be charged through the payment method you provided. You can cancel at any time through your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

Payments for subscriptions are processed by Stripe, Inc. Payment processing is carried out by Stripe, Inc. on behalf of the App.

We will never charge you for the App or its services without making it very clear to you exactly what you are paying for.

Refunds

Except where required by applicable law, payments are non-refundable and there are no refunds or credits for partially used billing periods. If you believe you have been charged in error, contact us at holin1sergey1@icloud.com.

Intellectual Property

The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, belong to EL Software Services LLC.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service or any part of it, except to the extent such restrictions are prohibited by applicable law.

Changes to the Service

EL Software Services LLC is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We may also suspend or discontinue the Service, in whole or in part, at any time.

Acceptable Use

You agree not to use the Service to violate any law; to interfere with or disrupt the Service or its infrastructure; to attempt to gain unauthorized access to any part of the Service; to use automated means to access, scrape, or collect data from the Service; or to resell, redistribute, or commercially exploit content from the Service.

Third-Party Services

The Service may rely on or link to third-party services, including payment processors, data providers, and app stores. We are not responsible for the content, policies, or practices of third parties, and your use of those services is governed by their own terms.

Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any content or prediction will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by applicable law, we and EL Software Services LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or gambling losses, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid for the Service in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any rights you have that cannot be limited by law.

Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use poses a risk to us, other users, or third parties. Provisions that by their nature should survive termination will survive.

Our handling of personal information is described in our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where required, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
